TERMS OF SALE
Ordering
You are responsible for supplying all required information when submitting an order, including complete name, shipping, and billing address (no P.O. Boxes), telephone number, a valid e-mail address, and a valid payment method. No responsibility is assumed for mis-delivery due to incorrect information supplied by a customer. Kush Fine Art reserves the right to refuse or cancel any order at any time, in which case the customer’s sole remedy is a refund of any payment(s) made for such an order.
Changes
It is not possible to change your order once it has been placed. The only exception is the delivery address, which can be changed if your order has not yet been shipped. To change the address for an unshipped order, please contact Kush Fine Art customer service at orders@kushfineart.com within 24 hours of placing the order.
Color Matching
You acknowledge and understand that the colors may vary slightly in person than from a computer or mobile screen. We are not responsible for this common color variation issue. No guarantee is made that any image as seen online will necessarily match exactly the colors on the final product.
Payment
Payment for any order must be made in advance at the time the order is placed. In the event of a stopped payment, disapproved charge or other failure to submit pre-payment, Kush Fine Art shall have the right to cancel the order or, if already shipped, to seek payment and hold customer responsible for any and all costs of collection, including but not limited to reasonable attorneys’ fees, as well as to charge interest at the rate of 1.5% per month (or the highest allowable rate by law if less than 1.5% per month) until payment is made.
Sales Tax
Applicable sales tax will be added to all orders submitted from Nevada locations. All others submitted from other States, Sales and Use Tax should be paid by the Consumer, where required by law.
Personal Data
All information submitted by you in connection with any order is governed by our Privacy Policy.
Shipping and Customs
Shipping charges:
Shipping charges from Kush fine Art to customers include packaging, handling, and insurance. Customer is liable for any additional shipping charges incurred due to incorrect address details given by the Customer on the order. Customers are liable for any shipping costs associated with replacement of damaged artwork/merchandise caused by customer or caused by a third party contracted by the customer.
Changes to the shipping address supplied must be given in writing by the customer by submitting a request to orders@kushfineart.com within 24 hours of placing an order.
Changes must be confirmed by Kush Fine Art customer service department to be effective.
Custom and duties
Customs are subject to regulations and laws of individual countries. All international customers are responsible for all international fees, customs, duties, taxes, and brokerage fees for all packages shipped to their country. Orders cannot be canceled, refused, or returned because of custom duties, taxes, or brokerage fees. Additional shipping fees will apply to re-ship the order if the shipment is returned to Kush Fine Art due to custom issues.
Delivery Time
Delivery time depends on the type of product and destination. Items ordered together may not always ship or arrive together.
Shipping
Orders can take 1-5 business days to process.
Shipments within USA:
- Merchandise: ships within 1 - 5 business days
- Jewelry: ships within 1 - 5 business days
- Limited editions: For unframed art allow 1- 2 weeks for delivery, for art purchased in a frame allow 3-6 weeks for delivery. All limited-edition artwork comes with a Certificate of Authenticity.
- Sculptures: Sculptures in stock ship within 2-3 weeks, allow 6-10 weeks for delivery on custom orders.
- Original Art, Art in progress pre-sale, custom orders: shipping time applies from the time art or merchandise is available to ship, allow 3 – 6 weeks for delivery.
International shipments:
Delivery time depends on the type of product and destination.
Note: we may decline to ship to certain destinations, such as countries subject to embargoes, sanctions, war, disturbances, local regulations, or other restrictions.
Damages to shipment
If the package shows sign of damage, it is your right to inspect the art before signing for it. Please do not refuse delivery and ensure that the driver notes that the piece was damaged due to delivery. Please keep the original packaging, including the box or crate and contact us at orders@kushfineart.com within 24 hours of delivery to file the Claim. Submit in writing a copy of the order receipt, the shipping receipt and photographic proof of the damage for us to review.
Returns and Refunds
All sales are final.
Jewelry:
ORDERS WITHIN USA: Jewelry can be returned within 7 days of receipt in their original packaging and in unworn condition. Contact orders@kushfineart.com prior to returning the Jewelry. Jewelry purchases from our inventory may be exchanged within two (2) weeks of the date of purchase either for another piece of Jewelry or for store credit. No refund will be issued on returned jewelry.
INTERNATIONAL ORDERS: At this time, all sales at Kush Fine Art are final. Due to the finality of your purchase, please check the measurements before ordering. If you have any questions just send us a message before purchasing at orders@kushfineart.com. In the event that your item arrives damaged please contact us within 24 hours of receiving your item.
Jewelry Warranty: All our jewelry pieces come with one year warranty. This covers manufacturing flaws and defects, replacing any ring side stone under 0.05ct that may get lost among other general repairs that may arise. Please note our warranty does not cover damage not caused by faulty materials, due to reasonable wear and tear through misuse or accident (like a bent ring or broken chain), lost items and improper storage of your product, scratches, chemical exposure. If a piece has been repaired or modified by someone other than KUSH FINE ART, the warranty will be voided. Pieces can only be deemed faulty by one of our craftsmen upon physical assessment. Failure to follow the care instructions will render this warranty void.
Items purchased through a third-party retailer will not be covered under KUSH FINE ART’s warranty. Please reach out to the company where the items were purchased from directly.
KUSH FINE ART requires an evaluation of the item in order to recommend the necessary repairs. Once evaluated, KUSH FINE ART Customer Service will contact you to confirm if the repair will fall under warranty. You will be provided all applicable options at that time.
KUSH FINE ART Customer Service will contact you to confirm if the repair will fall under KUSH FINE ART's fine jewelry warranty against defects in materials or workmanship. You will be provided all applicable options at this time, including the time it will take to complete your repair, the cost for the repair (for non-warranty repairs), and the cost of return shipping. To avoid delay, please be sure that someone will be available at your return shipping address when your jewelry is scheduled to be shipped back to you. If you would like to send your KUSH FINE ART jewelry for repair or refurbishment, please ensure that it is packaged securely with instructions containing the following information:
- Your name
- Return shipping address.
- Telephone number.
- Email address.
- A copy of the receipt or receipt information (required for warranty repairs)
- A description of the repair/refurbishment needed.
- Please insure your package for the purchase price.
Merchandise:
We are unable to accept returns for Books, Calendars and final sale items and any shrink-wrapped items that have been opened. Once purchased, Books, Calendars and final sale items and any shrink-wrapped items, that have been opened cannot be refunded.
Clothing and accessories:
We are unable to accept returns on clothing items and accessories unless a defect in materials or manufacturing has been noticed upon receipt. Contact orders@kushfineart.com within 24 hours of receipt to initiate the return.
General
All orders and transactions are also subject to the kushfineart.com Terms of Use policy, including, but not limited to, the limitations on damages and exclusions of warranties set forth therein.
The Terms of Use also include provisions for arbitration of disputes and other important terms you should review. Descriptions, images, references, features, content, specifications, products, price and availability of any products or services are subject to change without notice, and our current prices can be found on our Sites and Apps. No responsibility is assumed for any errors in listed prices or other information, all of which we reserve the right to correct. Orders are not final or binding until accepted by KUSH FINE ART. We reserve the right, with or without prior notice, to limit the available quantity of or discontinue any product or service; to honor, or impose conditions on the honoring of, any coupon, coupon code, promotional code, or other similar promotions; to bar any user from making any or all purchase(s); and/or to refuse to provide any user with any product or service. Kushfineart.com is not responsible for any delay or failure in delivery due to causes beyond its control, including, but not limited to, acts of God, war, terrorism, embargo, quarantine, accidents, fire, explosion, flood, severe weather, epidemic, riots, civil disturbance, unavailability of labor or transportation or any other similar or dissimilar cause. You are responsible for the proper and safe handling of any prints or other products you order from us. To the extent allowed by law, Kushfineart.com liability for any claim relating to any product purchased from us is the amount you paid for the product.
